Privacy Policy
At Noboclub S.A.S. ("Noboclub", "we") we respect your privacy and protect personal data in accordance with Ecuador's Organic Law for the Protection of Personal Data (LOPDP), its General Regulation and international best practices.
1. Data controller
Noboclub S.A.S., tax ID 1793209876001, registered office at Av. República del Salvador N34-183 y Suiza, Metropolitan Building, 8th Floor, Quito, Ecuador, is the controller of your data. Contact us at privacy@noboclub.com.
2. Data we collect
We collect data you voluntarily provide (name, email, national ID, address, financial information required for KYC), technical data (IP address, device type, browser) and usage data (pages visited, time on site) through cookies and similar technologies.
3. Purposes of processing
We use your data to: (a) provide the real estate crowdlending intermediation service, (b) comply with legal obligations before the Superintendency of Companies and UAFE, (c) send you marketing communications if you have consented, (d) improve site security and experience, (e) prevent fraud and money laundering.
4. Legal basis
We process your data based on: (i) your express consent, (ii) the performance of the loan agreement, (iii) Ecuadorian legal obligations, (iv) duly balanced legitimate interest.
5. Retention
We retain your personal data for the time strictly necessary for the described purposes, and up to 10 years after the contractual relationship ends, in accordance with Ecuadorian tax and anti-money-laundering regulations.
6. Recipients
We may share your data with: Ecuadorian banking institutions, authorised fiduciaries, external auditors, the Superintendency of Companies, Securities and Insurance, UAFE and the Internal Revenue Service (SRI) when legally required.
7. Your rights
You may at any time exercise your ARCO-POL rights: access, rectification, cancellation, opposition, portability, right to be forgotten and limitation of processing. Send your request to privacy@noboclub.com. You may also file a complaint before the Superintendency for the Protection of Personal Data of Ecuador.
8. Security
We implement appropriate technical and organisational measures: TLS 1.3 encryption, database segregation, role-based access control and annual information-security audits.
9. Changes
We may update this policy. We will publish the new version at least 15 days in advance and, when significant, we will notify you by email.
